4. WHAT DATA WE COLLECT & USE & HOW WE COLLECT OR PROCESS IT

We collect data and personal information from users and visitors to our website or social media channels, job applicants, customers, and others who provide data to us in person, by mail, or online.

Our products and services are directed to individuals who are legally entitled to use our services based on their age of majority and legal age of consent. Orders in our online store are not permitted for children and adolescents under the age of 18. Persons under the age of 18 are prohibited from providing us with personal information through any of our services. We deliberately do not store any personal data of persons under 18 years of age and advise parents and guardians to always supervise the activities of their children.

The data collected is divided into two types. Into personal data (which can be used to uniquely identify an individual) and non-personal data (which is not used for identification purposes).

4.1 WE COLLECT SOME NON-PERSONAL & NON-IDENTIFIABLE DATA

Such data is related to a visitor or non-identified user and is either provided to us or collected automatically through use of our services. Such non-personally identifiable data does not allow us to identify which visitor or user the data originated from. The non-personal data we collect consists primarily of technical and aggregate usage information, such as visitors’ and users’ browsing and clickstream activity regarding the Services, session heatmaps and scrolls, and non-identifying data regarding the user’s or visitor’s device, operating system, Internet browser, ISP, date/time stamp, etc.

4.2 DATA VIA THE CONTACT FORM ON OUR HOMEPAGE & WHAT HAPPENS TO IT

If you send us inquiries via the contact form, your data from the inquiry form, including the contact data you provided there, will be stored by us for the purpose of processing the inquiry and in case of follow-up questions. We do not pass on this data without your consent.

The processing of the data entered in the contact form is therefore based exclusively on your consent (Art. 6 para. 1 lit. a DSGVO). You can revoke this consent at any time. For this purpose, an informal communication by e-mail to us is sufficient. The legality of the data processing operations carried out until the revocation remains unaffected by the revocation.

The data you entered in the contact form will remain with us until you request us to delete it, revoke your consent to store it, or the purpose for storing the data no longer applies (e.g. after we have completed processing your request). Mandatory legal provisions – in particular retention periods – remain unaffected.

4.3 DATA FROM DIRECT MAIL INQUIRIES (NOT VIA THE HOMEPAGE) OR OTHER CORRESPONDENCE AND WHAT HAPPENS TO IT

In the case of data provided to us by individuals through inquiries on all subjects by contacting us directly by e-mail or otherwise, we proceed as follows.

If an inquiry about one of our services or products does not result in a long-term and upstanding customer relationship, and if there is no desire for further information (newsletters, event invitations, notification of events and promotions), we will delete your data and the mail history or correspondence after a reasonable period of time.

As a rule, all related data and information are personally reviewed and irrevocably deleted after one to two years, unless otherwise required by law, which may oblige us to keep them longer. We have no interest in storing your data longer than necessary and prefer to keep our storage capacity free for our active customers and our own affairs.

4.4 DATA FROM NEWSLETTER REGISTRATION & WHAT HAPPENS TO IT.

Any person can sign up through our website or in the store, for information about South East Performance Styria, SEPS e.U. and our products, as well as special offers and events.

If you would like to receive the newsletter offered by us, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the specified e-mail address and agree to receive the newsletter. Further data is not collected for the newsletter or only on a voluntary basis. We use this data exclusively for sending the requested information (advertising, news, promotions, competitions, event notices, etc.) and do not pass it on to third parties.

The processing of the data entered in the newsletter registration form is based exclusively on your consent (Art. 6 para. 1 lit. a DSGVO). You can revoke your consent to the storage of data (e-mail address and its use for sending the newsletter) at any time, for example via the “unsubscribe” link in the newsletter at the bottom or by e-mail to office@gohard.at. The legality of the data processing operations already carried out remains unaffected by the revocation of the newsletter.

Our informative newsletters are sent either via online services such as MailChimp (third-party marketing platform) or directly from our mail account (via Microsoft Outlook). We promise not to overwhelm you with pointless mails and only send exciting, funny, informative and nice content on given occasions. The data you provide for the purpose of receiving the newsletter will be stored by us until you unsubscribe from the newsletter and will be deleted after you unsubscribe. Data that has been stored by us for other purposes (e.g. e-mail addresses for the member area and other customer data) remains unaffected by this.

This site uses the map service Google Maps via an API. The provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

To use the functions of Google Maps, it is necessary to store your IP address. This information is usually transferred to a Google server in the USA and stored there. As the provider of this site and this service, we have no influence on this data transmission from and to Google. The use of Google Maps is in the interest of an attractive presentation of our online offers and the easy location of our location or the places indicated by us on the website. This represents a legitimate interest within the meaning of Art. 6 (1) lit. f DSGVO. 6.1 PLUG-INS VON FACEBOOK, INSTAGRAM, Linkedin, Twitter

Our Services include certain social media features and widgets, single sign-on features, such as the “Facebook Like” button, the “Share” button, or other interactive mini-programs (“Social Media Features”). These social media features (which are operated by Facebook Inc, 1601 S. California Ave, Palo Alto, CA 94304, USA) may collect data, such as your IP address or pages you visit on our website, and may set a cookie to ensure their full functionality. Social media features are hosted by a third party and your interactions, with such third party social media features, are subject to their policies.

The mentioned plug-ins are identified by Facebook logos – the white “f” on blue tile or in a gray circle, and a “thumbs up” sign. Instagram can be recognized by a white “camera” icon in a gray (otherwise colorful) circle. The Pinterest photo platform is identified by a white “P” in a gray (otherwise red) circle. When you visit a website that contains such a plug-in, your browser establishes a direct connection with the servers of Facebook (and Instagram) or Pinterest. The content of the plug-ins is transmitted by Facebook or Pinterest directly to your browser and integrated by them into the website. By integrating the plug-ins, Facebook/Pinterest receives the information that you have accessed this website. If you are logged in to Google+, Google can directly assign your visit to our website to your Google+ profile. 6.3 HOW LONG WE STORE YOUR DATA

We may store your personal data for as long as we have an ongoing customer relationship, as long as any user account you may have created or our homepage is active, or as otherwise necessary to provide you with our services. With regard to data that you provide to us directly and not via the homepage and the online store, please refer to section 4.5 for information on when this data is deleted.

We may also retain personal data beyond the deactivation of any user account and/or beyond your use of a particular service, to the extent necessary to comply with our legal obligations, to resolve any disputes, to prevent fraud and abuse, to enforce our contracts and/or to protect our legitimate interests.

We adhere to data retention policies, which we apply to the data we store. When the storage of your personal data is no longer necessary, we ensure its reliable and irrevocable deletion.

GENERAL INFORMATION ON STORAGE & TYPE OF DATA PROCESSING

All customer data and data of site visitors are stored and processed in compliance with the relevant provisions of the E-Commerce Act (ECG), all other relevant data protection regulations and in particular the EU-wide General Data Protection Regulation (DSGVO).

Your personal data, including your address and e-mail address, will not be disclosed to third parties without your express consent, which may be revoked at any time. Excluded from this are the service partners who require a transmission of data for order and payment processing (e.g. the credit institution commissioned with the payment processing). In these cases, however, the scope of the transmitted data is limited to the necessary minimum. However, it is pointed out in this context that complete data security cannot be guaranteed when communicating by email.

Every access to the online store and every retrieval of a file stored on the homepage is logged. The storage serves internal system-related and statistical purposes. Logged are: Your personal data, such as name, address, contact data, trade data, as well as the name of the retrieved file, date and time of the retrieval and the URL of the access. In addition, the IP addresses of the requesting computers are logged.
